Bethenny Frankel and her ex-husband, Jason Hoppy, are back in court to battle for custody over their 8-year-old daughter, Bryn Hoppy.
Jason Hoppy asked Judge Michael Katz to keep their joint custody agreement intact, while The Real Housewives of New York City star is asking for sole custody.
In court today, her attorney, Allan Mayefsky, declared their current joint agreement “no longer viable.”
“Why are we doing this? To protect the child,” her lawyer argued. “The father’s behavior before and after their marriage is extremely harmful to Bryn. His abusive behavior towards her not only damages her relationship with her
He continued, “We need to protect the mother. His anger at her for pursuing this divorce is evident. Frankel requested a criminal restraining order. It continues to this day up until these proceedings.”

Bethenny is accusing her former spouse of ‘manhandling’ Bryn… in addition to not flushing the toilet.
“[He was] physically pulling the child away from Ms. Frankel, leaving negative articles out about Ms. Frankel, [and] doesn’t flush the toilet,” Bethenny’s lawyer Allan Mayefsky alleged during his opening statements in a Manhattan court today, according to Page Six.
Her attorney also accused Jason of abusive behavior towards Bethenny’s dog Cookie, who passed away in late 2017.
“[He] locked up Cookie in a storage closet and wouldn’t reveal her whereabouts for hours,” he stated to a judge.
Hoppy’s lawyer painted a very different picture of their situation — claiming the duo are doing a great job co-parenting and accusing Frankel of making the custody battle about their relationship issues.
“The idea the relationship between the parties is so broken is not true,” his attorney Robert Wallack told the court.
“Bethany seems intent about making this trial about her, Jason, and their issues … Bryn is happy, healthy, smart and well-adjusted, is [a] good student and has lots of friends.”
